Hi All,

My OPT expires on March 20th 2012. According to USCIS rules, I am on valid F-1 status 2 months after OPT expiration. "nonimmigrant F�1 students on post-completion OPT maintain valid F�1 status until the expiration of the OPT period and the subsequent 60-day departure preparation period".

Is it possible for me to take advantage to cap-gap after expiration of OPT as I will still be on valid status? Can I quit work for 10 days after my OPT expiration and start working again on April 1st after a employer files my H-1?

Please advise.

Hello Senior Members,

I have just started a thread to ask if there is any need to call our local senators for co-sponsoring S.3084 ( Barbara Boxer), which is identical bill in Senate for HR 6039.

Is core working to get similar bills for HR.5882 and HR 5921 to get introduced in Senate?

Hello All,

I'm in a big fix now, need immediate suggestion and help.

I have a valid H1B petition filed from SC, now I had moved to FL and started working on a prj. I have planned for my trip to india early june and then I came to know from my lawyer that I need to have a new LCA and H1B amendment before traveling to india and appearing for visa interview.

They had already filed for my new LCA which I have got and they had applied for my H1B premium amendment also but I haven't got the new petition yet.
I have applied for the visa interview by filling all the DS-160 forms for my family based on old petition number.

Can I can still go ahead with the interview and carry the new amended petition in my hand OR should I cancel the existing interview and once again fill the new DS-160 forms and take the new interview date ?

Please let me know on this....

I am July 2nd filer and got EAD approved.

My 485 notice has Received Date as July 19th 2007 and Notice Date as October 17th 2007.

Do i need to calculate 180 days from July 19th 2007 OR Oct 17th 2007 if i want to change the jobs?

Well this is a peculiar case:

My OPT started may 15 06. I started working for my present employer from July 06 and we missed out on last years qouta and I was sure that they will apply for this years. Today my manager calls me up and says that we CANT. Now I am in a soup. May 15 -- Oct 1 break and on top of that I need to find a consultant who can sponsor me visa at this time. These are my questions:

1. I can get my general qouta H1 done by a consultant. So if I goto India, will there be any problems while stamping ??

2. Whats wise?? staying here, getting a new I-20 or going back to India ?? Because 4.5 months is a long time and I dont think I can afford the expenses here.

jaytubati - I have teh same situation, I already got my EAD card and I-130 approved documents. But today I got duplicate receipts for both I-765 and I-130 with rfe for photograpgh

Can you please shre your experience, what action did you took and what was the otcome? Any suggestions? thanks in advance

Hi

i recently got H1 Extension stamping ( Till 2011 ) and also have AP Expires in Nov 2008 .
I am working on H1 and not interested to use EAD .Do i still need to renew my EAD and AP?

just a tip not cool to hijack someone else' thread. on your question: If you are planning on being with the H1 sponsoring employer for the next few years no point renewing your EAD or AP. However they are two seperate filings. You don't need to have a valid EAD in order to apply for an AP renewal or vice versa. Hope this helps.

I think if you can prove the emergency to the consulate then you can book an emergency appt. I assume all H1's are eligible for this appt. SEnd a mail to consulate and chekc it out.

Hi,
My wife was in US in Oct 2007 on H4 Visa and went back in Mar '08 while she was in US we applied her H1B in 2008 and was approved and she got her H1B stamped in India and came back to US in Oct 2008. since she did not find any job, her payroll is not running and the her employer wants her to switch back to H4 Visa, and once she finds a project she can change her status back to H1B.

My Question here is
1) For COS from H1B to H4, Does she need Pay stubs? and how easy it is for the COS?

2) Her Employer says that she can apply for H4 Stamping and inform the Visa Officer that during her stay in US she did not join the company for medical reasons. Does this create any issues with her H1B.

3) Can Some one suggest a good immigration Lawyer in San Diego?

1) When do I have to apply for the 140 after the labor approved; what is the max time allowed after labor approval.

2) Name Correction in labor; what is procedure to correct my approved labor certficate and when/how to do this ...

H1 and GC are two different processes. Rejection of H1 does not impact GC.
