Hi
I am currently working on H1B visa. I also had an EAD which expired 2 months back & I applied for renewal of the EAD last month. I am at the risk of being laid off by my current employer & they will withdraw my H1B if that happens. Here are my queries-
(1) If I lose my H1 status & my EAD approval is still pending, what do I need to do? If I am unable to find a new H1B sponsor, will I have to leave US immediately?
(2) Will my H1 cancellation have any effect on my EAD & AP renewal petition?
(3) Can I return to US & work after my AP & EAD are approved?
(4) If my EAD approval happens before my H1B visa is revoked, can I legally stay & work in US on the basis of ONLY the EAD?

Date for application:
my question: I had applied to Vermont service center and later it was transferred to Texas Service center... So Should i put Vermont or Texas as the applied USCIS office?
Also, The date of application is that the day i signed the application? or the received date that i see on the approved EAD?

Would appreciate the input on my querries by the attorneys & the people who has experienced similar situation.

I got an email from USCIS saying my I-485 case is now transferred to National Benefits Centre and is now pending standard processing at a USCIS office.
I am travelling to India currently and plan to re-enter on AP.
I wanted to know if
1. anyone has any ideas as to what this really means, anyone received similar email, experiences?
My priority date is not current so are they pre-adjudicating my case or planning to send a RFE??
2. Should I take any specific steps while re-entering on AP?

No more interim EAD at Infopass since Sept 2006.
If it's an emergency like loss of job offer etc. you can take a cover letter with your receipt notice to Infopass and they can fax it to the Service Center for expedited service. Alternatively you can fax it yourself.
The decision whether to expedite your case rests with the Service Center.
Also I would say hang on for a few days if possible. I got my EAD approval e-mail after 101 days since RD from NSC.

The Obama administration announced a crackdown on Wednesday on hundreds of companies suspected of employing illegal immigrants, signaling a shift in strategy: going after employers instead of workers.
However, it is yet to know what steps the government would pursue if it verified that an employer had hired illegal workers, or how severe penalties might be. It remains to be seen how much pressure the new policy could put on employers. Interesting study. The headlines this morning around the country are on the subset of children of illegally present parents which Pew is estimating is about 7% of all children born in the US. It's not a surprise to see the GOP getting increasingly crazy as they know that in the long run they'll go the way of the Whigs unless they either convince Hispanic voters to support them or disenfranchise enough of them that they can continue to win elections with only Anglo voters.

Hi,
I applied for EAD renewal to Nebraska center on Dec 12th.
So far I didn't received the receipt and also my check didn't get cashed.
Did anybody encounter similar situation. If so please let me know what you have done.

Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

Hi all,
My ETA case in online status shows "DATA REVIEW" for the past 5 months, my PD Aug 04/RIR/EB2 is with Dallas BPEC.Initially the status was closed, and then opened. After 5 months of reopening it still says 'Data review' .Is there some thing wrong or should I talk to my lawyer.
Some of my friends who applied that time have their status 'in process' or even 'certified' .Any experience like this or will that go to certified from here directly or to "in process" first. How long it can be in each of these statuses.
Any ideas appreciated please!

Hello,
I need to renew my H1 for the 9th year and was wondering if I need to pay the ACWIA fee of $1500. It seems employers who are filing for a 2nd extension are exempt from paying. Does it apply also to cases beyond the 2nd extension?

I Lost my I797A (but having photo copy) . I want to go to my Home country on emergency for 2 weeks and return to US.
Will I get visa stamping with
1. Copy of I797A and Employee's related documents ?
2. Copy of I797A and Employee's related documents + Proof of Duplication Request ?
3. Whether Duplication form (I-824) Should be separately filed for L1 & L2 ?
Please guide me Immediately.

I think once the I-140 application is filed based on the state of residence, USCIS can transfer it to any service center. The applicant doesnt have any control over it. As far as I know, the applicant cannot request for a change in service center.
