My wife's I-539 got approved this month (H4 -> F1). My lawyer said that applying for AOS is not an issue as long as she does not travel outside the country while her AP is pending.

Marco Rubio has a challenge. He needs to appeal to conservatives in order to drum up enough votes to defeat popular Governor Charlie Crist in next year's Florida GOP primary. Then he has to run back to the middle to appeal to an increasingly liberal Florida general electorate. When it comes to immigration, he needs to come off as tough on illegally present workers. And then he somehow has to seem reasonable on the issue by the time he gets to the November election. The Miami Herald reports on how this is going to be a tough task.

I applied for I485 like many others in July. I just heard my group may be spun off from its parent company and might be funded by VCs. Does this mean I cannot use my LC/I140? If/When I get my EAD will it be valid?

No big deal....It does not affect you as long as your job is still same. The new company will take over your labour and I140 and you should be fine

Did everybody who filed Jul 2nd at NSC got their reciepts?
seems like TSC is done entering Jul 2nd application as Jul 3rd-5th are getting their reciepts. It makes me wonder as to how the reciepts are issued if Jul 2nd filers are waiting and farther dates got their reciepts. Is it only issuing delay ?

My attorney want's to file my I-485 now to have a receipt that it is filed and sent back by USCIS. This shows up that I was capable of filing in July but I could not because USCIS did not accept on the last minute.
The Idea behind is that it will give advantage to my application if AILF wins the case.
Please let me know is this a good thing to do at this stage.

My employer will file for H1 this April.
If my H1 is rejected for any reason, will I be eligible to work on F1 - OPT visa?

Pl. advise what all documents do I need to send to USCIS for extending stay on visitor visa for my parents.From all the sources I read so far here is the list of documents that I feel that needs to included :
1)I-539
2)Letter to USCIS (from me the sponsor) explaining the reason for extending the stay.Please post any letter format that I can use.
3)Copy of parents passport
4)Copy of I-94
5)Copy of original return ticket (with return date in 6 month from 1st entry)
6)$300 fees
Questions :
Do I need to sent I-131
Do I need to send bank statement and recenet paychecks
Do I need to buy new ticket for extended date and send a copy?
This is a last minute decision.I-94 expires in 3 weeks.PLease help .

Based on what I know, the medical exam has to be less than 1 year old on the date of I-485 application submission. However, I have seen different opinions on this forum. Some state that the exam date cannot be more than 30 days before I-485 submission, because the HIV test and syphyllis test (sorry if not typed correctly) are valid for 30 days only. Could anyone clarify this, please?

I was curious if somebody has experience of H1b stamping in dominican republic?
I am planning to go there on a business trip, is it advisable to just go and get it stamped there or should I rather go to canada/mexico and get H1 stamped.
