Hi all, I have a question regarding my current situation. I'm currently working for this non-profit organization under my OPT that is good until the end of Oct of this year. My question is basically whether or not I can ask my employer (already agreed) to petition for me for an H1-b visa? Can I still apply right now before my OPT expires or would it be better to apply next year on the first day of April? If I can get an approval for my H1-b would it be good to get a TN in the meantime and later have my employer petition me for an h1-B then?
Any suggestions would be greatly appreciated as I don't want to waste the opportunity to apply if I can get one at this time. I heard is better and easier to apply for one while under OPT than TN to H1-B but I'm not sure or rather confused about this!

Having a pending EB1 I-140 does not in itself confer any status. If you filed an I-485 concurrently, then you are permitted to remain in the US pending adjudication. If you have a currently valid H-1B you may remain or renew pending adjudication.

Hello There,
I just got an RFE on my 485 as following.
Submit a letter of employment attesting to your current employment. This letter should be written on the company's official letterhead and cite the date you started working, whether the position is permanent and full-time, a description of the position, a description of the position that you currently hold for the company (if any), and the offered salary.
When I invoked my AC21, my new lawyer submitted G-28 but with out any details about my new employment. I hoping that this RFE is related to that. My only concern is that my old job title is programmer analyst and my new job title is Business Solutions Architect with similar (probably a little more) job duties.
Please share your experiences if any one has received similar RFEs.

I was on H1.. but i quit my job and i am currently enrolled as a Full time student.
I need to go to Mexico as part of my Study program....
I have received the change of status from USCIS..but i need to get my passport stamped..
I have not been successful in getting an appointment in Canada....
>> Can i go to mexico and get the visa stamped during my stay there..is it risky???
>> i cam here on F1-h1-now back to F1.... do i have to go to my country of origin to get my visa stamped.

Anybody filed Un Signed Labor Substitution?
Since the cut off date was Jul 17th my attorney filed un signed Labor substitution with I-140.
Any experince any body has, I request you to share that here.
Chance of denial or rejection is very high if the Labor substitue application is not signed by the applicant.

I am applying for new H1b in April. Also I have 485 applied under EB2 with I-140 approved.
1. Can anyone tell me what all information about my green card status I need to share with prospective employer attorney to make sure they provide it in H1b application...???

Can people post experiences on turnaround time for getting medical test documents back from the doctor? I have heard 2-3 days after initial appointment, but the doctor's offices I have called say 7-10 business days. Also, I have heard that some doctor's are faster than others. Is this true?

Hello,
I am from India and currently visiting USA on B2 visa. I recently got a job with a very reputed firm in US and applied for an H1B but my application reached USCIS after the H1B quota was full.

Good Morning,
I would like to ask some questions about changing jobs. I am currently on a second H1-B, and have applied for a green card (Form I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS). The company�s attorney sent me the following form as a receipt: I797C application to adjust to permanent resident status.
If I decide to join a new company, what do they have to do? Can I change jobs keeping my current H1-B? Do they apply for another H1-B and then restart the green card process? What documents are required to port my current priority date?

Hi,
I finished my six years of H1B in August 2008. I filed my I140 with concurrent filing in July 2007. I also received my EAD card (pending I140) but I never used it. The time has come to renew my H1B for the upcoming year. My employer filed I129, which was approved by USCIS. Now my employer is asking me to renew the EAD but I don't want to spend the money. Do I have to have the EAD with my H1B? What do you guys think?

I have worked for Company "A"(Ex-employer) under H1-B(company A holding my H1-b) from 2007-2010. During 2009 & 2010, company A was unable to clear all my payments as the company went through some financial hurdles but they issued W-2 for the amount paid in fiscal year 2009. Now, company A has got money and they decided to clear my back wages for 2009-2010 through 1099 form. I transferred my H1-B visa to Company B(2010) then to Company C(current employer). Now, Company C has started my Green card(GC) process.
Questions:
1. I already received W2 for 2009. Can company A amend the W2 for the back wages?
2. Is it legal to take the unpaid amount under 1099? Will it affect my GC process?
3. What are my options to get my back wages from company A?
4. Company A want to issue 1099 along with a letter stating that i was full time employee for the time period mentioned in 1099. Is it acceptable?
I really appreciate your help for taking your valuable time in clarifying my questions. I look forward for your reply.

One of the comments on my post earlier today about the killed Border Patrol agent seemed pretty harsh - accusing most BP agents of being restrictionists with bad motives. I still think that's harsh and most Border Patrol agents are honestly out to do the necessary job of protecting our country's borders. I wish to share my experience at POE at Newark Liberty International Airport. This may be helpful to others.
I came back to US on last Sunday on AP/EAD.
There was no issue at all while entering on AP. In fact, there were several AP/ h1B candidates. Everyone was having smooth entry.
Immigration officers were asking everyone to relax and calm down.
One person ahead of me had first and last name completely switched on I-485 and EAD than from passport.
He explained that his first and last name got switched while GC filing.
After little investigation , he was also allowed to enter by immigration officers.
Overall my experience was very good about immigration at POE.
No need to afraid if we have proper documentation.
People are unnecessarily spreading panic and rumours.

PIC countries benefited from unused visas a lot till now to have their PD current/move up. So based on that benefit, Also one thing is clear the unused visas if available are country indepedent and are used at the rate of 27% per quarter.
so for example 100K visas are available (which i would enjoy having )27K per quarter is available from the start of the year . Now among this 27K how is the distribution, can it be distributed whichever applicant needs PD IRRESPECTIVE of EB1,EB2,EB3(skilled, professional) Vs EB3 other or does it split by the calculations of EB1, EB2, EB3 with 28% EACH and EB3 other NOT above 10K limit

Yes, the principal applicant should be fine to travel withou any affect on the MTR.
