My 11 year old neice is in Hong Kong and I want to know
could she come in as a tourist and have a school accept her in Houston Texas, then change the status into student using I-20 issued by the school?
how long it will take to have the status change? more than 2 months?
Do I have to get an immigration lawyer to do it? Or could I do it myself? If yes what is the form number?
Please help, thank you.
Sincerely,
Caroline Ho

Your attorney must have the answer. When you file an I-485, you should include a copy of the I-140 approval or receipt, so your better ask your attorney.

The USCIS has issued guidelines for petitioners filing cap-subject H-1B petitions for Fiscal year 2011. The guidance explains what that cap is, what petitions are subject to the cap, filing fees, where to file, etc. See here (http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=4b7cdd1d5fd37210VgnVCM100000082ca60aRCR D&vgnextchannel=73566811264a3210VgnVCM100000b92ca60a RCRD).

Some paras from Securing Iraq Votes, One at a Time (http://www.washingtonpost.com/wp-dyn/content/article/2007/03/10/AR2007031001300.html) -- House Democratic Leaders Methodically Build Support for War Plan
By Jonathan Weisman, Washington Post Staff Writer, Sunday, March 11, 2007
Rep. Jerry Nadler was the only lawmaker at a meeting of all House Democrats on Thursday to stand up and declare that he could not support a compromise plan to fund the Iraq war with a timeline to end the conflict. So some party leaders had written him off even as he joined House Speaker Nancy Pelosi for a private meeting.
In the confines of the speaker's suite, Nadler (N.Y.) could be specific. He sought assurances from Pelosi (Calif.) that President Bush would be compelled to withdraw all troops from combat by August 2008, as the legislation proposed. He wanted to know: "What is the legal compulsion to follow this timeline?"
A Pelosi aide disappeared from the meeting for a few minutes and returned with a few lines of legislative text offering what Nadler wanted to hear: Once troops are out of Iraq, no money would be available to put them back in, outside the narrow exceptions of targeted counterterrorism operations, embassy protection and efforts to train Iraqis.
"You know," Nadler said after a pause, "I think that's okay."
Nadler's conversion was a sign of the member-by-member, slow but deliberate headway Democratic leaders say they are making in their efforts to cobble together the 218 supporters they need to pass one of the most consequential pieces of defense legislation in decades, a $105 billion war-funding bill that would impose strict standards of rest and readiness for the military, establish clear benchmarks for the government of Iraq and set a timeline to end U.S. involvement in the war.
Through closed-door meetings, pep rallies, private phone conversations and horse trading, Democratic leaders are moving outward from the 180 solid votes in the party's political center to win the votes on the party's left and right that will be needed to pass the bill later this month.
The cajoling will continue tomorrow as lawmakers return to Washington and the legislation is readied for markup later in the week. But there are roadblocks: Rep. Allen Boyd (D-Fla.) said some conservatives are withholding their support until the language McDermott wanted is removed.
As Democratic leaders balance those demands, the calculus is fairly straightforward, said one conservative Democrat involved in the process. Leaders are counting on winning all but a dozen of the 43 conservative Blue Dog Democrats and all but a dozen of the 75 or so members of the liberal Out of Iraq Caucus. Then, Democratic leaders are hoping, enough Republicans will break ranks to put them over the top.
By last week's end, House Democratic Caucus Chairman Rahm Emanuel (Ill.) said, they had secured about 200 votes.
But the last 18 votes will not be easy. That point was brought home Thursday morning, during the closed-door meeting in which the legislation was detailed for Democratic members. As Pelosi gave her pitch, Reps. Lynn Woolsey (Calif.), Barbara Lee (Calif.), Lloyd Doggett (Tex.) and Nadler stood up to leave for a news conference of their own. After an uncomfortable pause, Pelosi growled that she wished Democrats would be courteous enough to hear her out before talking to the media. Nadler sat down. The rest walked out.
Democratic aides concede that some party members, including Woolsey, Lee and Doggett, are all but lost. But they are not giving up.
"There's nothing guaranteed in life, but I feel very good," Emanuel said.

My situation is: last entry to US with F1 visa as a student. After graduated, got H1 visa, but didnt leave US during the period.
When filling I485, need to answer the following questions.
1. In what status did you last enter?
For my case, should I fill F1 here.
2. Nonimmigrant Visa Number, Consulate where visa was issued and issue date?
Does this refer to my H1 visa number? If so, since it is not issued by consulate, how I can answer the last two questions?
Thank you veyr much.

Hi All,
My H1B(8+ year) is expiring, and my company is willing to file H1B with Engg manager role. My previous H1B or extension was files for software engineer. My GC(EB2) is filed as Software engineer, with PD as Jan 2006.
Questions
1) Now is it ok to file H1B with new title? What if H1B gets rejected?
2) How does this title change affect GC? Can the GC be cancelled because the title has changed or H1B gets rejected? The engg manager role is similar to software engneer role, except people responsiblities.
3) If the H1B gets accepted, then is there still a danger to GC? Do they verify GC papers before approving H1B?
Thank you, Raja

Is a person who was deported almost 30 years ago, and returned to the U.S. without inspection a year later subject to the permanent bar under the 1996 immigration law? The 1996 law created the permanent bar to the immigrating to the U.S. Section 212(a)(9)(C)(i)(II)provides as follows: "(C) Aliens unlawfully present after previous immigration violations.- (i) In general.-Any alien who- ...(II) has been ordered removed under section 235(b)(1) , section 240 , or any other provision of law, and who enters or attempts to reenter the United States without being admitted is inadmissible." The question is whether or not this...

The USCIS announced today, April 27, 2009, that it has received approxiamtely 45,000 H-1B petitions counting toward this fiscal year's general cap of 65,000. Therefore it will continue to accept H-1B petitions that are subject to the general cap.
Then USCIS also announced that it has received approximately 20,000 H-1B petitions for aliens with U.S. advanced degrees subject to the 20,000 advanced degree cap. However, the USCIS says it will continue to accept additional advanced degree petitions because it knows from past experience that some number of the advance degree petitions are not approvable for any number of possible reasons.
I will update this blog on the H-1B account as soon as the USCIS makes further announcements.

ILW.COM - immigration news: The Trials And Tribulations Of Highly Educated Immigrants (http://www.ilw.com/articles/2010,0120-donoghue.shtm)
Everyone saw this coming. It has been a steady decline in the situation in teh past 10 years.
The handwriting was on the wall for quite sometime.
They will eventually make the H1B unusable by IT firms/body shoppers.

Now that USCIS has dropped bomb by announcing the revised bulletin, do you think now they will be able to bring back the premium processing for I-140? or still they dont have time to "ensure" processing in 15 days.
Guys, what is your take on this.
I agree. They should bring back PP on I-140.

Hi All
I have submitted my Indian passport for renewal at Houston Indian consulate via mail , its been close to a month I havent heard anything from consulate. I tried calling them up, no one attends the call.
Do you have any idea how can I speed up this process? Does personal visit to Houston consulate will help in speeding this up? Does passport submitted via mail can be handed over to me in person ?
Thanks
Ashish

For a supposedly-sleepy dog day of summer, last Thursday produced a disturbing clash of views on employment-based immigration in the two Washingtons -- DC and WA. Seattle, about as far from the Beltway as one can go in the lower 48, hosted the Northwest Summit of ImmigrationWorks -- a coalition of large and small businesses bent on reforming the immigration laws in ways that will enable the economy to grow. At the same time, the Senate reconvened from its recess for about a half hour to pass H.R. 6080, a $600 million border enforcement law whose protectionist elements triggered an...

I had applied for an EAD and AP renewal in April 09. While I received my EAD and AP at the end of April 09, the EAD case in CRIS was still showing "Initial Decision".
Today I got a random email from CRIS saying that my EAD case is in post-decision activity and that they mailed my card in April 09 (DUH!!!).
When I go to check my cases in CRIS, my 485, EAD, AP from last year and AP from this year all show a soft LUD on 12/3/10.
Does this mean I have been preadjudicated? Or is this just a random event? Or does it mean dark clouds ahead???????

Will Sheriff Joe soon have to parade around in the striped jail uniforms he famously makes his inmates wear? According to the Arizona Republic: Maricopa County officials believe the discovery of a duplicate payroll log and database hidden in a secure computer system at the Sheriff's Office could reveal the extent of alleged misspending in Sheriff Joe Arpaio's agency. The sheriff's employee database operated parallel to a county-run system, recording a different set of sheriff's staff assignments and payments than official records provided to county auditors. County officials say the system has existed since the early part of the decade,...
