My PERM was filed on July 18, 2007. PERM got approved on July 26, 2007.
I-140/I-485 concurrent will be filed in first week of august 2007.
Which fee will be applied in this case ? New August filing fee or same July filing fee?
USCIS FAQ are confusing for this scenerio. I am sure lot of people are in the same boat. Kindly let me know what is the right filing fee for this scenerio.

Hi Fellow forum users
I and my spouse both have primary/derivative through each other. However I only have EAD (dependent) through my spouse's principal AOS. Can I use that to change my job? I dont have time to apply for a principal EAD. Once I start the new job in dependent EAD can I apply for an EAD based on my primary AOS so that my new employer can drop a AC21 mail to USCIS? The reason I want to do this is to maintain my principal AOS as well.

Find below my current visa status
1. H1B 6 years completing in Jul 2009. My firm will apply for extension in March time frame
2. I have applied for I-485 and have EAD + AP.
I am planning to travel to India for a week on AP sometime in May. I have the following Qs on this
1. Can I travel to India with AP when H1B extn is pending.
2. Will I face any issue while entering the US if my H1B is denied (or) there is an RFE on my appln?

Hi Folks,
I have a unique situation. Well.. I have been working for a Company A that is owned by my uncle. Iam on H1B in 2nd year and I have my I-140 approved 1 month back. Now I got a new job in another company B with 3 times the current pay of mine. I want to change to the company B.
My uncle said that he will continuing the process of my GC application, under EB2 in his company A. But I want to transfer my H1B only to the new company B, so I can get into the company B's payroll and get benefits. Can someone suggest how we can handle this without messing up with the current GC process with company A. Does changing to company B under new H1B impacts my GC processing. Can we show that the company A is processing my GC under future employement, though I worked for company A before..
Please advise the consequences and my options.. I badly want to work for company B..without stopping my GC processing with company A..

There is no relation between your first FP and FIrst EAD.
Your EAD card will come the message ' FP not available."
Sequence is fine...you should get your card in mail anytime now.

Hi,
I joined Company A in Oct 2008 and company A applied for my Perm Application in Jul 09. I joined another company in Oct 09 and now i want to join Company A again. can i use the same PERM application or do i need to file a new PERM application. I calculated my time in USA excluding time spent outside the country and my 6 years will end in June 2010. When my employer renewed H1 back in 2008 he simply claimed for 3 years and USCIS approved till 03/2011. But I read somewhere online that we have to calculate our time spent in the country and should not go by the date that is on our H1.
1. Does the change of status from H1 to F1 reset the H1 time period or do we have to consider that time period while calculating the 6 years
2. As my application (AAO) is pending I heard I will get a one year extension. The question I have is can I stay on my current H1 till 03/2011 or do I have to renew my H1?

My current status is
I currently work for Company A (on H1B) and Company B is processing my GC (EB2, I140 approved; I485 in process) .
This month, I found a new job with Company C which I have to join on EAD (they don't do H1Bs). Also, in this month's bulletin, my PD became current. I had a few concerns/questions
1) Could the change in employment trigger any flags since I am changing companies and this is a future employment GC case (though its almost 3 years since the I-485 was filed)
2) What do you suggest I do since its so close? I waited all this time just not to complicate things (and remain on H1) but then as soon as have to start work on EAD, the date also becomes current (which I am definitely very happy about ) but now since both these events are so close, I am not sure what to do.
3) What other things are there to keep in mind in case of a future employment case?

Since you were working all these times, please carry the W2 for 2008 ( for both of you). They may/may not ask for this, but its safe to carry the document
I am currently on H1 but planning to go on H4 due to current economic scenario.
I am planning to go to India due to some family reason and planning to get COS from H1 to H4 in India.
I have my salary slips and my husband has also maintained his status throughout.
Has anyone heard any horror stories about H4 stamping cases getting denied.
What documents they ask for when you go for COS from H1 to H4. Besides salary slips can they ask for my W-2's or they need my husband's W-2's only

I am on H1B and my wife is in H4 here. She is a nurse and can apply for the AOS before Aug 17 .But she does not have all certificate that makes her AOS approved at this time. We hope that we can obtain the certificate (Visa Screen certificate) by the time the RFE comes. But it is a 50-50 chance only. So what could be the best option for us and consequences of each.
My case (h1B)
1. I also apply for AOS with her so that I can get aGC along with her but do not use the EAD .
