As of August 14, 2009, approximately 45,000 H-1B cap-subject petitions and approximately 20,000 petitions qualifying for the advanced degree cap exemption had been filed. USCIS will continue to accept both cap-subject petitions and advanced degree petitions until a sufficient number of H-1B petitions (http://www.h1b.biz/lawyer-attorney-1137085.html) have been received to reach the statutory limits, taking into account the fact that some of these petitions may be denied, revoked, or withdrawn. Hello Gurus,
I got my EAD in 2007 and have been working for the sponsoring employer till now (Of course on EAD). Now I found a new opportunity w/ an excellent pay.
My designation and responsibilities at new employer are pretty much same as the current one but I see the difference in the salary --It is two times(2X) the current salary.
Is it OK if I accept this position with double salary?

The storyline continues. Last year, 13,500 regular H-1B applications were counted in the first week and 5,600 advanced degree applications. This year 5,900 regular applications were received in the first week and 4,500 advanced degree petitions. USCIS just reported that in the second week of counting, 7,100 regular cases were receipted and 5,100 advanced degree applications. - Applied for 9th Year H1B in October. (H1B Visa expired in Oct)
- EAD and AP approved.
- Just got CRIS email of I140 & 485 denial notices (waiting for the USCIS letter for reasons).
- Previous company closed down and I had given Experience letter from a colleague, who is now on H4.
Questions?
1. Am I out of status already due to denial notices?
2. Will I get an H1B Extension?
3. If my lawyer decides to file an MTR, will I be allowed to work until my EAD/H1B is valid.

In the right hand column on the homepage the threads used to be listed in chronological order with the one containing the last post on top.
Now it has changed so that I get the threads listed randomly.
Tech gurus - is there a way to fix this so that I can see the latest post on top like I used to previously.

Hello All,
I recently filed a labor and got A# and would like to know the options to check the status.
My employer is not willing to give the user id and password of the secured sire through which they filed the labor.
I would greatly appreciate your input.

Status of PERM can only be checked by your employer (with their user id and password of the secured site). Unfortunately there is no other way to check the status.

Hi,
I applied for SSN for my wife using the EAD,the person at the SSN office noticed that the date of birth on the EAD was not correct, but still took the application.Our lawyer reapplied for a new EAD last week but we recieved the SSN, please let me know if my wife can work using the SSN or wait till the reapplied EAD is approved.

Hey everybody, My friend have a situation. He is from Haiti and he been in the USA since 1998 on a visitors visa but stayed. Graduated school, but couldn't do nothing else because of his papers, he lived with his sisters and they didn't work on it. Had a little situation in 2007 where he left the scene of an accident because he didn't have papers. They called it a felony, and now the (TPS) came around and he got denied because of that felony. He doesn't know where or what to do, don't have money for lawyers because he cant work. Anybody out there been there that knows what to do please feel free to do so. GOD bless

I want to consult an employment/labor lawyer with regards to an employment agreement that I have signed with a desi consulting company in US. They have sponsored an H1b for me which I am yet to get stamped. I am in India right now and wanted to talk to a Labor lawyer who could tell me the effects of not joining this employer given that there are certain terms and conditions stated in the agreement. Could you suggest me some law firm in US where one can speak to a lawyer on the phone for a reasonable amount of money and seek legal advice.

I have a approved I-360 (Batter Spouse Petition) and a pending I-485. However I got a letter in the mail stating the will revoke my 1-360 based on Section 204(a)(1) of the Immigration and nationality Act! It further states that I am not a person of Good Moral Character.
I was arrested in Belize my home country on November 19 2002 for Harm.Which would be Assault, and charged $100.00 and released.
This was not include in my initial application becausse it was outside the 3year period since my application was in 2007.
So I got the court documents and I am ready to submit it! but I am not sure if I shoudl seek legal advise or just submit the required document that they want!
They are asking for:
1.) Arrest Report.
2.)Copies of Cout documnet showing final disposition.
3.) relevan excerpts of the law for that jurisdiction showing Maximum possible penalty for each charge.
Please advise! is this something I should be feareful of?
